Terms of Service

Terms governing use of the Kitsap Fireplace directory, guides, public feed, and related services.

These Terms govern your access to and use of Kitsap Fireplace, including its directory, guides, public data feed, and related pages.

1. Acceptance of these Terms

By accessing or using kitsapfireplace.com (the “Site”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site. “Kitsap Fireplace,” “we,” “us,” and “our” refer to the operator of the Site under the Kitsap Fireplace name.

You must be able to form a legally binding agreement to use the Site. A parent or legal guardian is responsible for a minor’s use of the Site.

2. What Kitsap Fireplace is

Kitsap Fireplace is an independent local directory and educational publication. We organize public information about fireplace stores and showrooms and publish general buying and research material for greater Kitsap. We are not a fireplace retailer, installer, contractor, manufacturer, code official, permitting authority, inspection agency, financial adviser, lawyer, or emergency service.

The Site is provided for general informational and discovery purposes. It does not create a contractor-client, professional, fiduciary, agency, partnership, employment, franchise, or endorsement relationship between you, Kitsap Fireplace, or any listed business.

3. Directory information and no endorsement

Directory records may include names, addresses, phone numbers, websites, product categories, service descriptions, and other facts drawn from business-controlled or authoritative public sources. We try to identify the source and date checked, but information can become incomplete, inaccurate, unavailable, or outdated.

Inclusion, position, omission, or removal of a listing is not a recommendation, certification, ranking, warranty, or statement that a business is suitable for your project. At launch, seeded listings are unpaid and featured placement is disabled. If commercial placement is introduced later, it will be labeled and will not purchase a favorable review or alter verified facts.

You are responsible for independently confirming current hours, addresses, products, prices, availability, service areas, qualifications, licenses, insurance, permits, warranties, and project scope directly with the business and responsible authorities.

4. Safety, permits, codes, and professional advice

Fireplaces, inserts, stoves, chimneys, gas lines, electrical work, venting, fuel storage, combustion, smoke, carbon monoxide, and structural modifications can create serious risks. Site content is not a substitute for manufacturer instructions, an address-specific site assessment, a qualified and properly authorized professional, current building or fire codes, permits, inspections, or official burn restrictions.

Rules and conditions change. Confirm current requirements with the authority responsible for the project address before purchasing, installing, modifying, or operating equipment. For an emergency, fire, suspected gas leak, carbon-monoxide alarm, or immediate safety concern, leave the area when appropriate and contact 911, the utility, fire department, or another responsible emergency service. Do not rely on the Site for emergency instructions.

5. Third-party businesses, websites, and services

The Site links to independent businesses, government resources, mapping tools, and other third-party websites. We do not control their content, security, accessibility, privacy practices, products, services, statements, or availability. A link is provided for convenience and source attribution, not endorsement.

Your communications, visits, purchases, installations, warranties, disputes, and other dealings with a third party are between you and that third party. Their terms and privacy policies apply. We are not a party to those transactions and do not process payments for listed businesses.

6. No public accounts, reviews, or transactions at launch

Public registration, public reviews, public listing submission, online payments, newsletters, and advertising accounts are not enabled as of the effective date. The presence of technical sign-in, dashboard, or submission components does not invite public access. You may use an account or restricted feature only if we expressly authorize you.

If we add accounts, submissions, paid placement, or transactions later, additional terms, disclosures, eligibility rules, or consent steps may apply.

7. Permitted use and intellectual property

Subject to these Terms, you may access and use the Site for lawful personal, household, research, and business-discovery purposes. The Site’s original text, design, selection, arrangement, branding, graphics, code, and compilation are owned by or licensed to Kitsap Fireplace and are protected by applicable intellectual-property laws. Business names and third-party marks belong to their respective owners.

You may quote brief portions with clear attribution and a link to the relevant page when permitted by law. You may not copy, frame, mirror, sell, license, republish, or create a substitute directory from substantial parts of the Site without written permission, except as applicable law allows.

8. Public directory feed and automated access

We provide a public, source-attributed directory feed for reasonable machine-readable access. Public availability does not waive our rights in the Site’s selection, organization, original descriptions, or presentation. Automated access must be proportionate, must respect technical controls, and must not disrupt service, evade limits, misrepresent provenance, remove disclosures, or use the Site to create deceptive or unlawful content.

We may change, rate-limit, suspend, or discontinue the feed or other automated access at any time.

9. Corrections and communications

You may send a correction, ownership question, privacy request, or other communication to gpt@aldermedia.net. Do not send passwords, payment-card data, government identification numbers, health information, or other sensitive information.

When you provide text, documents, links, photographs, or other material, you represent that you have the right to provide it and that it is accurate to the best of your knowledge. You grant us a nonexclusive, worldwide, royalty-free license to review, reproduce, adapt, verify, and use that material as reasonably necessary to respond, maintain records, correct the directory, enforce these Terms, and operate the Site. A request does not transfer editorial control or guarantee a change, listing, response, or publication.

10. Prohibited conduct

You may not:

  • use the Site for unlawful, fraudulent, deceptive, harassing, defamatory, infringing, or harmful activity;
  • submit false business information, impersonate another person or business, or misrepresent authority to act for someone;
  • upload or transmit malware, harmful code, spam, credential attacks, or material that violates another person’s rights;
  • probe, scan, bypass, interfere with, or gain unauthorized access to the Site, accounts, servers, security controls, or data;
  • overload the Site, scrape it at an unreasonable rate, evade access limits, or interfere with another visitor’s use;
  • use Site content or data to facilitate discrimination, stalking, doxxing, unsafe conduct, deceptive endorsements, or manipulative link schemes; or
  • remove copyright, source, relationship, safety, or commercial disclosures.

11. Availability, changes, and enforcement

We may correct, update, remove, reorganize, suspend, or discontinue any listing, page, feature, feed, or the Site without notice. We may restrict access when we reasonably believe use violates these Terms, threatens security, infringes rights, creates legal risk, or disrupts the Site. We do not guarantee uninterrupted, error-free, secure, or permanently available service.

12. Disclaimer of warranties

To the fullest extent permitted by law, the Site and all content, listings, links, feeds, and features are provided “as is” and “as available,” without warranties of any kind, express or implied. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, completeness, availability, and results. We do not warrant that a business will respond, that information is current, that a product or project is suitable or lawful, or that the Site will be free from errors or harmful components.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Kitsap Fireplace and the Site’s operator, contributors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, use, or goodwill; property damage; personal injury; or losses arising from your reliance on the Site, dealings with third parties, installation or operation decisions, or inability to use the Site.

To the fullest extent permitted by law, our aggregate liability for any claim arising from or related to the Site or these Terms will not exceed the greater of the amount you paid us to use the Site during the twelve months before the event giving rise to the claim or US $100. Because the Site currently charges no visitor access fee, that limit will ordinarily be US $100.

These limitations do not exclude liability that applicable law does not allow us to exclude or limit.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Kitsap Fireplace and the Site’s operator, contributors, contractors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use of the Site, your violation of these Terms, material you provide, or your infringement of another person’s rights. This section does not require a consumer to indemnify us for our own unlawful conduct.

15. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Subject to any consumer right that cannot be waived, disputes arising from these Terms or the Site will be brought in the state or federal courts with jurisdiction in or serving Kitsap County, Washington, and you consent to their jurisdiction and venue.

Before filing a claim, you and we agree to make a good-faith effort to resolve the dispute informally by emailing gpt@aldermedia.net with a description of the issue and requested resolution. This informal step does not extend a legal deadline or prevent either party from seeking urgent relief.

16. General provisions

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Site, except for additional terms expressly presented for a specific feature. If a provision is unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our consent; we may assign them in connection with an organizational change, asset transfer, or operation of the Site.

17. Changes to these Terms

We may update these Terms as the Site, law, or our practices change. We will post the revised Terms here and update the “Last updated” date. Material changes may also be highlighted on the Site when appropriate. Your continued use after revised Terms take effect means you accept the revised Terms, to the extent permitted by law.
